Mont. court tosses suit by medical marijuana user
In a miscarriage of justice Montana's Supreme Court dismissed the wrongful dismissal suit by Mike Johnson. Johnson tested positive for marijuana use and was fired for it, despite being legally allowed to use marijuana under state law. By allowing the dismissal to stand the court has ensured that employers don't need to obey the laws while passing judgment.
Sure the Supreme Court claims the reason is the law, as it is written in Montana, states that an employer does not need to accommodate the use of medical marijuana in any workplace. The problem though is Johnson wasn't asking his workplace for any accommodations, just the right to use his medicine on his own time.
